Terms of Service
Using Monochrome Lab Pro.

1. Who we are and what these terms cover.
Monochrome Lab Pro and this website are provided by Tony Shepherd, operating under the PixByShep brand ("we", "us", or "our"). Contact: tony@pixbyshep.com.
These terms cover use of monochromelab.app and Monochrome Lab Pro, including any trial and activation services. By using these services, you agree to these terms. A purchase is also subject to the terms presented by the seller at checkout. These terms do not remove rights granted with an earlier purchase or rights that cannot be limited by law.
2. Your software license.
A valid purchase grants you a non-exclusive license to use Monochrome Lab Pro for personal or commercial photographic work on the number of computers included in your purchase. The one-computer plan covers one Mac; the two-computer plan covers two Macs. You own your photographs and the work you produce. The software and website remain the intellectual property of their respective owners.
You may not resell or redistribute the software or activation codes, share a license beyond its computer allowance, bypass trial or activation restrictions, or use the services unlawfully. Rights granted by applicable open-source licenses and any rights required by law remain available; included third-party components are subject to their own notices and licenses.
3. Trials and activation-enabled editions.
Where offered, the trial lasts 14 days from the time it is started through the activation service. No payment card is required and the trial does not automatically convert into a purchase. After expiry, editing and new exports require a valid paid license; your original photographs and saved work remain yours.
Activation-enabled editions require an internet connection to start a trial or activate a license. The trial can then work offline until it expires. Paid activation supports up to 30 days offline between successful license checks; reconnecting renews activation without another payment. To move an activation, deactivate the old Mac first or contact support if that computer is unavailable.
Preview builds and sandbox purchases are for testing. A sandbox code is not a paid production license. Availability and requirements are described with the relevant download.
4. Prices, payments, and delivery.
License prices and computer allowances are shown on our Pricing page. A one-time purchase has no recurring license fee. The price, currency, applicable taxes, and delivery instructions shown at checkout govern your order.
For purchases processed by Paddle, Paddle is the merchant of record and authorized reseller. Its Buyer Terms govern that transaction. Paddle handles payment processing and applicable transaction taxes. For purchases through our existing PixByShep store, use the seller and support details on your receipt.
Delivery is electronic through the download and, where applicable, activation instructions supplied with your purchase. A purchase covers the software described at the time of sale; it does not promise every future feature or major upgrade at no additional cost.
5. Refunds.
You may request a full refund within 14 calendar days of purchase for either license plan. The refund window starts on the purchase date, independently of the free trial. The full conditions and request process are in our Refund Policy, which forms part of these terms. For Paddle purchases, Paddle’s refund policy and your statutory rights take precedence over any conflicting restriction here.
6. Your files, compatibility, and support.
Photo editing takes place locally on your Mac. You are responsible for maintaining backups of originals, catalogs, presets, and exported work, and for ensuring you have the right to use your images and other content. System and camera requirements are listed on our Pricing page.
We aim to provide reliable software and help resolve reported problems. We do not promise uninterrupted service, compatibility with every device or third-party tool, or a particular creative result. Send support requests to tony@pixbyshep.com with your app version, macOS version, and a description of the issue.
7. Service changes and misuse.
We may update the software and services to fix defects, improve compatibility, or protect security. We may suspend trial or activation access for fraud, unlawful use, or material breach of these terms, and revoke a license when the corresponding purchase is fully refunded or reversed. Where appropriate, contact support to resolve an activation problem. Suspension does not transfer ownership of or authorize deletion of your photographs.
8. Warranties and responsibility.
To the extent permitted by applicable law, the software and services are supplied as available, without additional guarantees beyond those expressly stated at purchase. We are not responsible for problems caused by unsupported systems, third-party changes, or misuse. Nothing in these terms excludes liability that cannot lawfully be excluded, limits mandatory warranties or remedies, or removes consumer protection rights.
9. Privacy and updates to these terms.
Our Privacy Policy explains how information is handled. We may update these terms and publish the revised date here. Material changes will be communicated where required. Changes will not retroactively remove rights attached to an existing purchase. Questions or complaints can be sent to tony@pixbyshep.com.
